Appellate Law

Areas of Practice / Appellate Law

What is Appellate Law?

Appellate law is the area of law that focuses on reviewing decisions made by trial courts to determine whether legal errors occurred that affected the outcome of a case. Rather than retrying the facts, appellate courts evaluate how the law was interpreted and applied.

What does an Appellate Attorney Do?

An Appellate attorney focuses on legal analysis and written argument rather than presenting witnesses or evidence.
Their work may include:
  • Reviewing transcript, evidence, and rulings from the trial court
  • Identifying appealable legal errors
  • Writing persuasive briefs
  • Presenting oral arguments before appellate judges
  • Advising clients on likelihood of success and legal strategy

Why Should I Consult an Appellate Attorney?

Appeals involve strict procedural rules and deadlines, and the arguments are based heavily on legal reasoning rather than factual disputes. Having an attorney experienced in appellate practice is essential to ensure issues are properly preserved and presented.

At Harstell & Williams, our attorneys carefully review trial court proceedings to determine whether errors occurred and develop a strategy aimed at achieving the best possible outcome. We guide our clients through the appellate process and clearly explain each step along the way.
Our attorneys can guide you through the complicated process of filing and pursuing a non-criminal lawsuit through mediation or in court.

Civil litigation is a major part of the legal realm and it’s often the most intense in terms of personal legal needs. Litigators are also called ‘trial attorneys’; and if you are in need of a civil litigator you need an experienced legal representative with a lot of knowledge. Our firm has, and remains, a prominent firm when it comes to litigation needs. Our firm was built on the desire of two prominent litigators to join forces. It’s in our history, a history that is continually told in the daily passion our litigators exhibit in each circumstance in which their skills are needed.

Civil litigation isn’t limited to these areas, but mainly includes:

Alimony: Provision for a spouse after separation or divorce.
Personal Injury: Injury to the body, mind, or emotions
Debt Settlement: An agreement on debt reduction in which the debtor and creditor agree on a reduced balance as an end to the debt.

All areas of Appellate Law:

  • North Carolina Court of Appeals
  • North Carolina Supreme Court
  • Appeal from Administrative Law Judge’s Hearing
